BACKCOUNTRY SKIING CANADA, ANDREW CREIGHTON, BRAD STEELE WILL NOT BE LIABLE FOR ANY DAMAGES OR LOSS OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR SIMILAR DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, LOSS OF USE OR SIMILAR ECONOMIC LOSS ARISING OUT OF OR RESULTING FROM YOUR POSSESSION, ACCESS OR USE OF THE SITE OR THE INFORMATION OR MATERIALS PROVIDED THEREIN, INCLUDING, BUT NOT LIMITED TO, LIABILITY ARISING FROM YOUR RELIANCE ON THE CONTENTS OF THE SITE OR AFFILIATED SITES, ERRORS IN THE DATA, AND DATA LOSS OR CORRUPTION, REGARDLESS OF THE BASIS OF SUCH LIABILITY. 6. Indemnification.
You agree to defend, indemnify and hold harmless Backcountry Skiing Canada and its affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses (including all attorneys' fees) arising out of your use of the site and any information, services and/or goods provided via the site.
7. Viruses.
Backcountry Skiing Canada assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the site, or your downloading of any materials, data, text, images, video, or audio from the site.
8. Changed Terms.
Backcountry Skiing Canada has the right at any time to change or modify the terms and conditions applicable to use of the site, or any part thereof, or to impose new conditions, including, without limitation, adding fees and charges for use. 10. Refund Policy.
Merchandise purchased through Backcountryskiingcanada.com is not refundable or exchangeable. Backcountry Skiing Canada is not responsible for merchandise damaged through shipping, late shipping or lost shipping.
11. Shipping Terms & Conditions.
Backcountry Skiing Canada will promptly process and ship your order but we do not guarantee delivery times to Canada, the USA or anywhere else. Should your delivery go missing after we have processed and shipped the order and while in transit you will be responsible to follow up with the proper postal service to find out more information regarding its location. Any orders shipped as general mail will not be trackable and come with no insurance for replacement. Only larger orders shipped as parcels will have tracking included. We take no responsibility for orders once they are shipped, lost orders are the responsibility of the delivery company that has been used to deliver the package which is generally Canada Post and then secondary mail companies depending upon your destination country. All orders outside of North America are quoted with ground shipping and will take several weeks to arrive at their final destination. If you require air shipping please contact us for a quote prior to placing your order.
12. Privacy Policy.
